What Is The Iowa Consumer Fraud Act?

by admin on December 28, 2011

All educated consumers can benefit from an awareness of the laws that the local government has passed to protect their rights, and should know what steps are required to utilize them when necessary.  The Iowa Consumer Fraud Act (related to the Buying Club Memberships Law) protects consumers against unfair or deceptive practices in many facets of business, including the sale, lease, or advertisement of products and services.  What the law essentially does is allow the Iowa Attorney General, whom at present is Thomas J Miller, to step into situations where fraud is suspected and take proper action to remedy the problem and provide relief for consumers. So, the next thing you’ll probably want to know is what the legislation actually provides to handle these difficult situations for consumers, and to exactly which situations the legislation applies.

In Iowa, the law offers Tom Miller, who is also a 2012 presidential candidate, several avenues of recourse to deal with the sort of questionable practices that go on in all industries.  To enforce consumer protection, the Attorney General may issue subpoenas to the suspected parties, hold hearings, and file both temporary and permanent injunctive lawsuits to create immediately relief for consumers.  The type of relief the law authorizes the Attorney General and the state of Iowa to provide can come in several forms, some of which include settlements paid to consumers, reimbursement for attorney fees, and civil penalties.  The law also gives consumers the ability to sue companies when they feel they have been victims of consumer fraud, or misrepresentation, or any other crime relating to unfair business practices.  In cases like these, consumers may recover damages as well as seek punitive damages, where appropriate.
